Terms of Service

These Terms of Service ("Terms") govern your access to and use of Boatee ("Platform"), operated by Boatee ("we", "us", "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old to create an account. By registering, you confirm that you are of legal age and that all information you provide is accurate and truthful.

2. Your Account

• You are responsible for maintaining the confidentiality of your password and account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately at support@boatee.co if you suspect unauthorized access
• You may not create multiple accounts or transfer your account to another person

3. Platform Access

Boatee is currently offered free of charge during its launch period for both Boatees and providers. We may introduce paid plans or premium features in the future, but any such changes will be communicated clearly before they take effect.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Post false, misleading, or fraudulent marina or service provider listings
• Harass, threaten, or harm other Boatees
• Scrape, copy, or reproduce Platform data without our written consent
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure
• Use automated bots or scrapers to access the Platform
• Interfere with the security or performance of the Platform

By submitting content (reviews, logbook entries, listings, posts, depth readings), you:

• Grant Boatee a non-exclusive, royalty-free licence to display, use, and improve the Platform using that content
• Confirm that your content does not infringe on third-party rights
• Acknowledge that we may remove content that violates these Terms or our community standards

7. Marina and Service Listings

Boatee makes reasonable efforts to ensure the accuracy of marina and service provider listings but does not guarantee the accuracy, completeness, or availability of any listing. Always verify marina information directly with the facility before arrival.

8. Intellectual Property

All Platform content, features, branding, and technology (excluding user-submitted content) are owned by Boatee and protected by applicable intellectual property laws. You may not reproduce or distribute any part of the Platform without our written permission.

9. Limitation of Liability

To the fullest extent permitted by law, Boatee shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to navigation errors, loss of data, or decisions made based on Platform information. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any conduct we determine to be harmful to other Boatees, providers, or the Platform. You may delete your account at any time. Upon termination, your right to use the Platform ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a Platform notice at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be resolved exclusively in the courts of Ontario, Canada.
